Is Online Poker legal in USA?
It all started with Unlawful Internet Gambling Enforcement Act of 2006 (or UIGEA). This is added to an Act of Congress called the SAFE Port Act, which was passed by the United States House and Senate on Sept 30, 2006 and signed by the then President Bush on October 13, 2006 turning the Act into Law.
This act, quote, "prohibits gambling businesses from knowingly accepting payments in connection with the participation of another person in a bet or wager that involves the use of the Internet and that is unlawful under any federal or state law."
The immediate fallout of this act on online poker is the pullout of PartyGaming, the company that runs Party Poker, from US operations just after the passage of the act in 2006. The company also paid off a penalty of $105m under a non-prosecution settlement with the American authorities, for offences it admits to committing before it withdrew.
The next big effect is the infamous "Black Friday", April 15th, 2011 when the top 3 online poker sites, PokerStars, Full Tilt Poker and Absolute Poker are shut down by US Department of Justice. Another 10 gambling sites were indicted on 23rd May, 2011.
Yet, the debate on whether online poker is illegal in US has been going on for years ever since the UIGEA act. In fact many have questioned the manner of the act itself. The Economist weekly news magazine commented, "A 2006 law, hastily tacked onto the end of unrelated legislation, bans American banks from handling money related to internet gambling" (Source). The Act also while putting Poker illegal, has oddly exempted Stocktrading and HorseRacing!
Another argument put forth by lobbyist is that the game of Poker is more of a "skill' rather than "luck". This argument is gaining momentum in the effort to legalise online poker. The UIGEA act had banned financial institutions from transferring funds for bets in which “opportunity to win is predominantly subject to chance.” A big supporter of this argument is the Poker Players Alliance (ww.theppa.org) which boasts of over 1 million members. They have been arguing in the US supreme court and are now lobbying hard to make online poker legal in the United States. This view is also subscribed by experts in the field of poker, prominent US university professors and world chess grandmasters too.
In the meantime, several US states are making moves towards legalizing & regulating online poker within their own states in order to boost taxes. Although with the Black Friday incident, legalization of online poker in the USA goes down a notch, there are people that believe that this crackdown might be the last one before the US government takes a U-turn and legalize it altogether.
